What is Stamp Duty

The modern system used today is known as Stamp Duty Land Tax (SDLT), which replaced the previous Stamp Duty regime on 1 December 2003 is administered by HM Revenue & Customs (HMRC) and applies to most purchases of land and property in England and Northern Ireland. The tax has evolved over time with rates and reliefs regularly updated by the Government to reflect housing policy and market conditions.

What is Stamp Duty?

Stamp Duty Land Tax (SDLT), commonly referred to as Stamp Duty, is a tax charged by HM Revenue & Customs (HMRC) on the purchase of property or land in England and Northern Ireland. The amount of Stamp Duty payable depends on several factors, including the purchase price, whether the property is residential or non-residential, whether you are a first-time buyer, whether you already own other properties, and whether the purchaser is an individual or a company.

Stamp Duty forms part of the overall cost of purchasing a property and is separate from expenses such as deposits, legal fees and mortgage costs. It is an important consideration when budgeting for a property purchase, as it can represent a significant upfront payment.

Stamp Duty for Individuals

As company purchases can involve more complex tax considerations, purchasers should seek advice from their solicitor, accountant or tax adviser to ensure they understand their obligations before completing the transaction.

When Does Stamp Duty Have to Be Paid?

Stamp Duty becomes payable once the property transaction has completed. In most cases, your solicitor or conveyancer will submit the required Stamp Duty Land Tax return to HM Revenue & Customs (HMRC) and arrange payment on your behalf using funds you have provided before completion.

Current legislation requires the SDLT return to be submitted and any tax due to be paid within the deadline set by HMRC following completion. Failing to meet this deadline can result in penalties and interest charges, so it is important that the necessary funds are available in time.
